The following is a brief summary of selected ordinances and serves only as an informational tool. For specific and/or detailed information relating to Borough Ordinances to include Codes Violations or Property Maintenance, contact the West York Fire Department Codes Enforcement at 717-843-6305. For further information related to other Borough Ordinances contact the West York Police Department.
 

Abandoned Vehicles: It shall be unlawful for any motor vehicle, to include trailers, to remain parked on any and all streets and alleys of the Borough for periods in excess of 72 hours. (Ord. 284)


Ball Playing: Ball playing, including the throwing, kicking or knocking of any ball, snowball and the throwing of any stone or other missile of any kind upon or onto any of the public streets, alleys or sidewalks in the Borough are prohibited. (Ord. 358)

 

BB Guns and Bow and Arrows: No person shall fire or discharge any firearm, BB gun within West York, nor shall they shoot any bow and arrow on any of the streets or alleys or public property in the Borough or any location where the arrow shall be directed onto any street or alley or public place. (Ord. 277)

 

Curfew: Unless accompanied by a Parent, it shall be unlawful for any minor to be at or remain in or upon any public place between the hours of eleven o’clock (11:00) P.M. and six o’clock (6:00) A.M. It shall be unlawful for any business to allow a minor in violation of curfew to remain on premises. (Ord. 502)

 

Daytime Curfew: It shall be unlawful for any minor to be at or remain in or upon any public place during scheduled school hours on any day in which school is in session in the School District of West York or other school district. (Ord. 502)

 

Dogs Barking: No person owning or having custody of a dog shall cause or allow such dog to bark continuously for more than thirty (30) minutes at night time. (Ord. 305)

 


Dogs Running at Large:
No person owning or having custody of a dog shall cause or allow such dog to be in upon any public street, alley, sidewalk, park, playground or other public area unless such dog shall be accompanied by a person to whom it shall be tethered and restrained by a leash not exceeding eight (8) feet in length. (Ord. 305)

 

Drinking in Public:  It shall be unlawful for any person to consume alcohol, liquor, or malt or brewed beverages upon any public street, alley sidewalk, park or playground, or upon any other municipal property within the Borough. (Ord. 331)

 

Exterior Maintenance: The exterior of the premised and all structures thereon shall be kept free of all nuisance and any hazards to the safety of occupants, pedestrians and other persons utilizying the premises and free of unsanitary or noxious conditions; and shall be so maintained that they do not constitute a blighting factor for adjoining property owners. It shall be the duty of the owner, operator or occupant to keep the premises free of hazards which include brush, weeds, broken glass, loose shingles, crumbling stone or brick, excessive peeling paint, stumps, roots, obnoxious growths, filth, trash, garbage, rubbish and debris; overhanging ice and snow; ground surface hazards to include holes, excavations, breaks, objections, obstructions, icy conditions, un-cleared snow, excretion of pets or other animals on paths, walks, curbs, driveways, parking lots and parking areas. Premises should be landscaped. All signs permitted by reason of other regulations shall be maintained in good repair. Signs no longer in use, shall be removed. No person shall park, stop or stand any motor vehicle or permit or suffer the same to be done in any front yard area. (Ord. 367)
 

Fire Pits: No person shall kindle or maintain any bonfire or rubbish fire or authorized any such fire, out-of-doors without first having obtained a permit. (Ord. 360)

 
Noise: No person shall make or continue, or cause to make or continue, or being in a position to control its source, allow to be made or continued any noise or such loudness or intensity, or of such duration, as shall disturb and offend a reasonable person of ordinary sensitivies. (Ord. 382)
 
Parks:  No person shall occupy or remain upon any public park or playground from dusk to dawn. (Ord. 437)
 
Scavenging/Scrapping: From the time of placement at curbside or at a drop-off center of any designated recyclable materials, all such designated materials shall be and become the property of the Collector in the case of curbside collection. It shall be unlawful for any person other than the Collector or Borough to collect or pick up or cause to be collected or picked up any such designated materials from curbside or drop off center. Skateboarding:  It shall be unlawful for any person to use skateboards, roller skates, street skates, or scooters on any public street within the Borough.

Skateboards, roller skates,
street skates, and scooters may be operated upon sidewalks within the Borough between 8:00 A.M. and sunset provided that the person operating the skateboard, roller skates, street skates, or scooters shall do so in a safe and responsible manner and shall always yield the right-of-way to pedestrians. It shall be unlawful for any person to use any skateboard, roller skates, street skates or scooters on any sidewalk in a reckless manner.

 

Skateboards, roller skates, street skates, and scooters may be operated within the Boroughs parks between 8:00 A.M. and sunset provided that the person operating the skateboard, roller skates, street skates, or scooters shall do so in a safe and responsible manner, shall always yield the right-of-way to pedestrians, shall not operate the skateboard, roller skates, street skates, or scooters in a reckless manner, and shall not operate the skateboard, roller skates, street skates, or scooters on any of the equipment installed in the public parks or in such a manner as to damage or destroy any equipment, structures, or improvements in the public parks. Snow and Ice: The owner of every property fronting upon or alongside of any of the streets in the Borough of West York is hereby required to remove or cause to be removed from all of the sidewalks in front of or alongside of such property, all snow or ice thereon fallen or formed within twelve (12) hours after the same shall have ceased to fall or be formed. The snow or ice shall be removed to a width of not less than three (3) feet and shall not be shoveled into the gutters, crosswalks or cart ways, but shall be placed along the outer or inner edges of the sidewalk or walkway. (Ord. 498)

Transient Retail Business:
No person shall engage in any transient retail business within the Borough of West York without first having obtained from the Borough a license. Transient Retail Business is defined as engaging in peddling, selling, canvassing, soliciting or taking orders, either by sample or otherwise, for any goods, wares or merchandise, upon any of the streets, alleys, sidewalks or from house to house, or at any fixed location. (Ord. 281)


Weeds and Vegetation:
It shall be unlawful for any person, firm or corporation, owning or having a present interest in any real estate within the Borough of West York to permit any weeds or vegetation whatsoever, not edible or planted for some useful or ornamental purpose, to grow or remain upon such premises so as to exceed a height of six (6) inches.


Yard Sales:
No person shall conduct a garage sale or yard sale on any property without first obtaining a permit. Yard sales may only run from 7:00 A.M. to 9:00 P.M. No person may have more than two (2) yard sales within a year, and shall not exceed more than four (4) days each. Signs for such sales may be placed at the location of the sale, but may not be placed on roadways, poles, traffic control devices or on other signs. Permit must be displayed during sale. (Ord. 461)
